Terms of use
1. General terms and conditions for use of the platform and services
Use of the "Data for Managers - remote training" platform (hereafter the “Site“), entails full acceptance of the terms and conditions set out below. These terms and conditions may be changed or added to at any time. Users of the Site are therefore invited to consult them regularly.
Access to the Site is by invitation only.
The Site is regularly updated by HappeningCo, the owner of the Netexplo brand. Similarly, the FAQ and Credits may be modified at any time. They are nevertheless binding on users, who are invited to refer to them whenever possible in order to familiarize themselves therewith.
2. Presentation of the Site
The Site is the property of HappeningCo SAS, listed on the Paris register of companies under number B447906165, SIRET #447.906.165.000.17, with registered offices at 264, Rue du Faubourg Saint-Honoré, 75008 Paris,
The current version of the Site was designed by HappeningCo and developed by WeUp Learning, 5 rue de Conflans 94220 Charenton-le-Pont, which is also responsible for maintaining the Site.
The Chief Editor is Flore Segalen, HappeningCo, 264, Rue du Faubourg Saint-Honoré, 75008 Paris, France.
3. Services provided
The purpose of the Site is to present the remote training program (content and tests) that enables users to obtain the HEC Paris "Data for Managers" Short Certificate.
4. Contractual restrictions on technical data
The minimum setup required for access to the site is as follows:
- Works on Firefox, Google Chrome, Safari and Internet Explorer 8+
- On smartphones or tablets, the platform works on the operating systems’ embedded browsers
- HTML5 video (iOS)
- The Site’s users shall only access it with equipment that meets the above-described criteria and is virus-free.
5. Intellectual property
The names Netexplo and formationadistance.dataformanagers are registered trademarks of HappeningCo.
HappeningCo is the sole owner of the intellectual property rights or holds the utilization rights to all the material on the Site, in particular text, images, video, graphics, icons and audio.
Any reproduction, representation, modification, publication or adaptation of all or part of the material on the Site, regardless of the media or process used, is prohibited without the prior written authorization of HappeningCo.
Any unauthorized use of the Site or any of its components shall be considered an infringement and give rise to proceedings in accordance with articles L.335-2 et seq. of the French intellectual property code.
6. Limitations of liability
HappeningCo may not be held liable for any direct or indirect damage to the user’s equipment when visiting the Site, whether resulting from use of equipment that does not meet the specifications set out in point 4, or from the appearance of a bug or incompatibility.
7. Protection of personal data
Access Codes enable the user to log into the subscribed services on the platform. These Codes are personal and confidential. They may be modified online by the User or by HappeningCo at the User’s request (Codes forgotten or hacked, etc.). The User is wholly responsible for the use of their Access Codes. Unless proven otherwise, any login to the Site or transmission of data from the User’s Access Codes shall be considered as made by the User.
The User shall keep their Access Codes secret and not disclose them to any third party in any form whatsoever. In that respect, the User has the possibility of logging out explicitly at the end of each session. In the event of the loss, theft or disclosure of their Access Codes, the User shall inform the platform without delay by email or post. The platform shall then cancel the User’s Access Codes without delay. Following this procedure, the User shall receive a new password.
HappeningCo shall comply with legal and regulatory provisions, particularly EU general regulations #2016/679 on data protection of April 27, 2016 (“GDPR”) and French law #78-17 of January 6, 1978 on information technology, data and liberties, as amended by the law for trust in the digital economy of June 21, 2004.
HappeningCo shall ensure the confidentiality and security of personal data concerning the users of its website. For more information on such processing, please refer to the Site’s Confidentiality Policy.
HappeningCo shall take all the technical and organizational measures needed for the security of the Data, taking into account the state of the art, implementation costs and the nature, scope, context and purposes of processing, as well as the risks, of varying likelihood and severity, to the rights and freedoms of individuals, in order to guarantee a relevant security level for such risks.
8. Cookies.
Navigation on the Site leads to the installation of “functional” cookies in the user’s browser. A cookie is a small file that does not allow the user to be identified, but records information on a computer’s navigation on the site.
9. Applicable law, jurisdiction
Any dispute with respect to the use of the Site is governed by French law. The competent Paris courts shall have sole jurisdiction.
